Pay your damn taxes!


American Soldier says,

This is a little off the genre of what is usually posted on this site but it sort of ties into freedom, honor, country, etc. There is a couple in Plainfield, NH that has been convicted of tax evasion. The story can be found here. They both have been sentenced up to 62 months in prison. The situation as of today is that they are hold up on their 110 acre property and are not going to go out without a fight. Their main argument is that the law does not clearly state that any citizens have to pay taxes. I’ve done some looking and this is what I found.

US Constitution, Article 1, Section Eight, combined with the 16th Amendment, as ratified BY THE STATE OF NH in 1913.

This has been getting a lot of attention in the New England area. The support is also growing, not sure why? New Hampshire’s state motto is Live Free or Die. This couple has written that motto on the front of their shields in this matter. I think they have distorted the motto and what their actual freedom entails.

The local police, U.S. Marshals and FBI have surrounded the couple’s property. They vow they will not go on their property. I am beginning to wonder why? I would hate to see any American harmed or killed for what they believed in. I just think they need to look beyond their personal belief and look at the big picture. Taxes pay for their security. Taxes pay for soldiers to defend our land. Taxes pay for the roads to be paved so they can go to Wal-Mart for a gallon of milk. To challenge the law and to attempt to make a mockery out of it is unacceptable.

I say we take the Browns and take their 110 acres and drop them off in the middle of Iraq. They don’t want to pay taxes then let them not enjoy what every other tax paying, law abiding American enjoys. Freedom! It really does come with a price. The problem that I have is when they goes to jail; I will be paying inadvertently through my taxes to house his ass in jail. Gotta love it!

    Okay so they don’t want to pay taxes, let them either 1. GIVE that money to the Armed Forces to fight the war on terror or 2. enlist in the service of their choice.

    They need to pay their taxes like everyone else or off to jail they go!

    I’ve read about a similar case in rural NY state when I lived up there for two years and it never made any sense to me. The other folks were protesting the federal dollars supporting various war efforts and funding our military. The hippies would talk about it like it was an admirable thing to do, but I don’t see how any of their actions relate to their cause. The Brown’s use the roads, the street lamps, public bathrooms, hospitals, parks, sidewalks on Main street, etc. and probably even have a library card. My point here is that these folks use the benefits of our combined federal tax dollars all the time even if they say they don’t.

    How is not paying taxes then paying a lawyer who does pay taxes making a legitimate point? If they don’t believe in taxes, then they should work for justice and try to change the laws regarding tax payments. It’s just as dumb as picketing an Army base or blocking the entrance to a military recruiter’s office because you don’t like the government’s participation in the War on Terror. How is harassing those in the military doing anything towards the change you want to happen? It’s not. It is just making those who disagree with you more firm in their position that you’re a loon and totally in the wrong.

    Besides, we all pay taxes and do things we don’t want to do all the time because we love our country and want it to be the best it can be (although I’d like us to get back on track and see more folks respecting and living with traditional values, but I’m getting off track here myself!). If we all didn’t pay taxes and abolished taxation completely, what would our country be like? A third world country. Is that what these people are fighting so hard for?

    Considering how our Government has been running the last several years, I can understand why this couple does not want to pay their taxes.

    Having said that, I understand the need for taxes, because even though there is a lot that goes on with my taxes, paying for stuff I totally disagree with, there are areas that need my taxes. Our national defense is one of them.

    Yes, our taxes are being used for many services that the founding fathers never intended. However, they are necessary, and provide much needed services. Just wish I could control more as to what services are using my tax monies.

    Although you have a right to say what you wish, personally I think you are an idiot just from the first sentence. If you don’t like our Government, then move to Canada. Maybe there you will have more of a say as to where your money goes. Better yet, join the couple in NH. Come on David, you sound like you are leaning way to the left.

    If they have 110 acres, I assume they grow something on them and it would be interesting to know what subsidies they have received - from the govt. ie tax payers

    No AS, I am not leaning to the left. Maybe, I didn’t say it as well as I could. I was talking about how the Democrats have been running things since they took control, but also how many Republicans have not been much better with their spending programs. Taxes are very important, and many times I have mixed emotions about dealing with taxes. I go back and forth between a flat tax, a user tax, and other form of taxes. Yes, taxes are extremely important, but many in Congress look at our taxes as a giant slush fund and we as Americans, in general, do not hold them accountable for how they spend our taxes.

    For me, I wish that more of my taxes would go to the military and for defense. I am tired of my government spending taxes on programs that I do not agree with. I want my country strong and to be able to defend itself against any and all threats that come our way. I want to have my son grow up in a country where we do not have to fear Islamic terrorism, and to know that our borders are secure and strong.

    I am tired watching our congressmen and women undercut the military; tired of watching my dad (who served honorably for over 20 years in the military) seeing his benefits cut again and again.
    I would love to see the military get the same percentage increase in their allotment as many of the social program percentage increases.

    Maybe, AS, what I meant to say was that I would rather see my taxes go to places that are critical needs for our country instead of watching my taxes being used by Congress to buy votes.

    AS, I probably didn’t phrase this the best way, but I hope you understand my heart.

    I can understand why people would refuse to pay their taxes. It does not mean I agree with them, and I surely would not go down that same path. I have run across those who believe that the IRS is an unconstitutional organization and that taxes (or at least the way we pay them now) are unconstitutional. I do not agree with that viewpoint.

    We still live in the best country in the world, and there is no other place I would rather live.

    Fair enough David. Taxes could go to so many different things other than the usual. I wish the Government could fund Stem Cell research but it won’t in this cabinet. When that check comes every two weeks it will still deduct the same amount no matter what. I just take it for what it is.

    I don’t understand what this couple thinks we would do without paying taxes. We all get some benefit out of paying taxes although everyone gripes about them, even me Ha! :grin:

    I am sorry but I have to agree with the Browns in this case, I have been searching the United States Codes under Title 26 and cannot find the exact law that states that MY personal income can be taxed directly. Nor can any agent at the IRS that I have asked, the only comment that I have gotten was that they just had the authority to do it. So I have to ask can anyone point at the exact statute within Title 26 of the USC that says that I am liable to pay income taxes? The amendment does not count, as the amendments are used to test for constitutionality of the US Codes under the law of the land, and the 14th amendment subjects the states laws to the same constitutional test.

    The Free Exercise of the Constitutionally guaranteed right to lawfully acquire property (earnings and other compensation) by lawfully contracting one’s own Labour to engage in lawful, innocent and harmless activities for lawful compensation cannot be (and therefore has not been) taxed for Revenue Purposes, and therefore, an individual who is only engaged in lawful, innocent any harmless activities is NOT subject to any “Income Tax” or any other Revenue Tax, and therefore is NOT a “taxpayer” as defined by law, and can therefore be properly and accurately described as a Non Taxpayer!

    United States courts have ruled that:
    “The revenue laws are a code or system in regulation of tax assessment and collections. They relate to taxpayers and NOT to nontaxpayers. The latter are without their scope.
    No procedure is prescribed for nontaxpayers, and no attempt is made to annul any of their Rights and remedies in due course of law. With them [nontaxpayers] Congress does not assume to deal, and they [nontaxpayers] are neither of the subject nor of the object of the revenue laws.”

    Long v. Rasmussen, 281 F. 236, at 238 (1922).
    Economy Plumbing and Heating v. U.S., 470 F.2d 585, at 589 (1972).

    Research it before you persecute and judge people for acting well with in their given American Rights. It’s seems to me that you are just not as aware of the laws as this couple is. I guarantee once you do some research and realize that you have been volunteering your tax dollars all these years that you will have the same views as the couple you are degrading right now. Do you really think that all the money we pay in taxes is supporting the war? What about $400 Billion dollars a year that is spent on “misc.” spending. That money is coming from your volunteered income tax.

    I don’t believe at all that this couple is any less american for excersizing their rights.

    I believe that you can twist and re-define just about anything. You can quote archaic laws, etc. The bottom line is Taxes is a part of life. Unless we completely get rid of the IRS and all that define our current tax laws then it is the obligation of every American to pay their taxes. And no, I don’t believe all our taxes go to the war.

    The couple in NH is wrong in many ways and their persistence in challenging the law will NOT make them a martyr of law.

    As far as paying their taxes to pave roads and support the military, income tax does nto pay for that; property pay for those items. The only thing personal income tax pays for is the interest on the federal reserve loas .. you know those billions we are in the red. Those are to the Fedreal reserve. A group of bankers that print the US money. The congress has the authority to print money the questiois why are we paying all this money to have someone print the money?

    As far as income tax, income tax is a tax on corperate activity not personal earned income. The state laws also are written so that anyone required to pay federal income tax is obligated to pay state income tax. Federal income tax is not mandated it is a voluntary tax. that came into effect in 1913.

    There is an interesting documentary by Aaron Russo, “America: Freedom to Fascism” that takes an objective look at taxes, and one of the things the film makers tries in earnest to accomplish is to actually see the law and wehre in the law it states we are obligated to pay taxes.

    How were these people found guilty? Did the Jury as to be shown the actual law. If nothing else if you are on such a jury ask to be shown the law. If they do not produce it, or they say you do not need to see it, then how can you find such a person guilty?

    See the movie and understand why one juror on another tax evasion case voted not guilty. Pretty interesting stuff.

    I think everyone of us should be thankful to pay our taxes. Look at all the good they pay for. I agree there are things going on in our congress and House of Rep., but we the people have the power to vote into office who we want. If we as a country really want to change Washington DC, we can! BUT let us be thankful for all of the good that our taxes do pay for. Most of the taxes we pay - makes life so much better for us. We should be a very thankful and grateful people. We live in the best country in this world. We should be extremely thankful and show honor and respect to all of our soldiers in all of our countries generations. These are the true keepers of our gates, our way of life, and the best of who we are as a people.
